Terms and Conditions of Use

1. Access to Net-Change.com.
   1. You agree and understand "unlimited access" does not guaranty you will always be able to access the Internet through Net-Change.com, or you will never be disconnected. Rather, "unlimited access" means your monthly account invoice shall be based upon a flat fee regardless of actual access, and shall not be based upon actual connect time and/or access.
   2. No limit on hours used, but this is not intended to be a fulltime connection. Member agrees not to provide any public information services over this connection and to keep the connection active only when the member is actively using it.
2. Passwords
   1. During the term hereof, Net-Change.com shall provide Customer with access to the Internet by supplying Customer with a unique security code(s). Passwords will be the manner of access to the Internet when access is gained through public dial-up telephone equipment and services.
   2. Net-Change.com will use its best efforts to provide a requested Password to Customer, but may deny the same based upon considerations including but not limited to security, confusion with other Passwords, offensiveness or infringement upon proprietary and legal rights of others.
3. Fees and Charges.
   1. In consideration of its connection and access to the Internet, Customer shall pay to Net-Change.com, in advance, any set-up fee and monthly use fee associated with the requested services.
   2. Net-Change.com is not responsible for long-distance charges incurred while connecting.
   3. Accounts in default are subject to current reconnection fees.
   4. Delinquent accounts may be charged a monthly late fee and may result in disconnection.
   5. Cancellation of any rate will only take place once we receive notification from the subscriber by phone, letter, etc.
   6. Early cancellation of prepaid accounts will result in a $20.00 Cancellation Fee. Only the unused portion of the prepayment will be refunded (no partial months) - less any discounts received for prepaying.
   7. Your initial payment for services are non-refundable.
   8. Monthly use fees are subject to change upon thirty (30) days written or electronic notice.
4. Customer restrictions and duties.
   1. Customer shall be responsible for maintaining the security of the Password(s) issued to Customer.
   2. Customer shall make efficient use of the Internet and any service or system available through Net-Change.com.
   3. Customer shall not upload, download, communicate or transmit any software or information in violation of copyright laws or other proprietary rights, or would violate any other federal, state or local law or regulation.
   4. Customer shall not use Net-Change.com to transmit any information, communication, software or similar where the contents of the same, or its transmission or distribution, would violate any federal, state or local law or regulation, or would be highly offensive to anyone with access to the same.
   5. Customer shall not use any Net-Change.com personal account for commercial purposes. Customer may not redeliver or redistribute to third parties for commercial or common use any services or products provided by or available through Net-Change.
   6. Customer understands dialup accounts are single modem accounts. If Net-Change detects concurrent connections on the same account, an access surcharge will be imposed in addition to the regular monthly fee.
5. Warranty. Net-Change.com and JCMM Ventures, LLC make no warranty, express or implied, as to its services in connection with the Internet, use thereof, or the accuracy or correctness of any information available through Net-Change.com including, but not limited to, any warranties or merchantability or fitness for any particular purpose. Net-Change.com exercises no control whatsoever over the information from the Internet passing through it.
6. Limitation of liability. In no event shall Net-Change.com or JCMM Ventures, LLC be liable to customer for any indirect, special or consequential damages or lost profits arising out of or related to this agreement, the performance or breach thereof, or the accuracy or correctness of the information available through Net-Change.com.
7. Term. The term of this Agreement shall be until either party terminates the same, upon thirty (30) day written or electronic notice. Customer shall be responsible for all charges identified in Paragraph 4 above through the effective date of termination. These Terms & Conditions are subject to change. Notwithstanding termination by notice as identified herein, Net-Change.com reserves the right to immediately terminate Customer's subscription due to any breach of this Agreement or policies of Net-Change.com.
8. General.
   1. Applicable Law: This Agreement shall be interpreted in its entirety in accordance with the substantive laws of the State of North Carolina.
   2. Net-Change.com encourages full and fair use of the Internet and all services and information therein. Unlawful, infringing, harassing, sexually explicit or obscene uses thereof shall not be tolerated. Any such use may result in the immediate termination of your Net-Change.com account.
   3. JCMM Ventures, LLC and Net-Change.com makes no representations and accepts no responsibility for the accuracy and contents of any information or services provided on the Internet.
